A judge recently ruled that Craig Chaquico, former lead guitarist of Jefferson Starship, is allowed to pursue his breach of contract claim against current band members David Freiberg and Donny Baldwin for performance and merchandising revenues made since January 2016. Chaquico filed the lawsuit against his ex-bandmates in order to prevent them from continuing to perform under the band’s name. In the origianl complaint, Chaquico alleged that the bandmates and their new colleagues are performing as “Jefferson Starship” in violation of an agreement to retire the name over 30 years ago.
KWIKH Partner David Swift, who represented Chaquico, said, “We are thrilled that the court rejected defendants’ statute of limitations argument and allowed Mr. Chaquico to proceed with his core claim against David Freiberg and Donny Baldwin for their unauthorized and improper use of the name Jefferson Starship in violation of their written agreement to not do so.”
