KHIKS wins for ‘Twin Peaks’ co-creator in published Court of Appeal opinion

KHIKS partners Dale Kinsella and Jonathan Steinsapir secured a complete victory for client Mark Frost last week, when the California Court of Appeal issued a published opinion affirming the entry of summary judgment in his favor.

Mr. Frost is an award-winning author and screenwriter who has written numerous books and screenplays.  He is also the co-creator of the fabled television series, Twin Peaks.

Among many other books, Mr. Frost is the author of The Match: The Day The Game of Golf Changed Forever, a chronicle of a legendary private golf game played on Cypress Point in 1956 by then-amateurs Ken Venturi and Harvey Ward, against renowned professionals Ben Hogan and Byron Nelson.  A production company claimed that Mr. Frost had reneged on a contract to allow it to produce a motion picture based on The Match and filed suit against him for breach of contract, negligent misrepresentation and other causes of action in 2010.

In a published opinion, the Court of Appeal affirmed the Superior Court’s summary judgment in Frost’s favor, holding that no contract had been formed and that all of the Plaintiff’s claims failed as a matter of law.
